As part of the support services offered to its customers, Schwab Performance Technologies ("SPT") may, with the consent of the customer, elect to remotely access the customer's computer for purposes of identifying and remedying support issues. The remote access services are provided as a convenience to the customer and may be terminated by SPT at any time, without cause.

THE REMOTE ACCESS SUPPORT SERVICES ARE PROVIDED "AS-IS AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. SPT DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE REMOTE ACCESS SUPPORT SERVICES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, TITLE, MERCHANTABILITY, QUIET ENJOYMENT, QUALITY OF INFORMATION, AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL SPT OR ITS AFFILIATES BE LIABLE TO THE CUSTOMER OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, PUNITIVE, EXEMPLARY, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LOSS OF GOODWILL, OR BUSINESS REPUTATION, BUSINESS INTERRUPTION, BREACH OF SECURITY, LOSS OF DATA, OR LOSS OF BUSINESS INFORMATION) ARISING OUT OF THE REMOTE ACCESS SUPPORT SERVICES, EVEN IF THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES.

If you elect to receive the remote access support services, you agree to be bound by the foregoing terms and waive any and all claims, now known or later discovered, that you may have against SPT arising out of the services.
